The expertise of members of Littleton in commercial litigation covers a broad spectrum of commercial law and procedure: international disputes involving conflicts of laws, civil fraud, banking, commercial contract, including share and business sale agreements; shareholder disputes, company and partnership law, sale of goods, franchising and commercial agency as well as disputes involving confidential information and [soft] intellectual property.

Members have particular expertise in disputes involving interim injunctions (freezing and search orders in particular) and a track record of successfully obtaining injunctive relief for their own clients and discharging that obtained ex parte by their opponents.

Our Commercial Litigation practice includes:

  • Arbitration: Littleton has a strong connection with arbitration, both domestic and international. It was the first set to establish an arms-length dedicated arbitration group, which gathers together a number of highly regarded international arbitrators, and members of Chambers at all levels of call are frequently instructed to appear in arbitrations either individually or in teams.
  • Trade: including Sale and Carriage of Goods, Commercial Agents.
  • Banking:We offer clients a wide range of expertise in banking matters and our members have advised major lending institutions on Banker and Customer Disputes, Consumer Credit Act matters, and Guarantee Claims.
  • Civil Fraud: Littleton has a strong reputation in civil fraud matters, developed through involvement in long-running and heavy cases.Our members appear regularly in the Commercial Court, Chancery Division, and the Court of Appeal as well as in arbitrations both in London and abroad.
  • Confidential Information & Soft IP: Littleton has long standing experience and expertise in cases involving confidential information/ trade secrets/ soft IP. Our members regularly advise on and assist in the drafting of confidentiality provisions in employment and commercial contracts. Confidential information issues arise in both employment and commercial cases and our barristers cover the full range of business sectors.
  • Injunctions: We are the first port of call for many clients seeking to obtain or resist urgent injunctive relief, especially freezing or search orders, in both domestic and international litigation. Littleton expertise extends to all urgent commercial interim matters. It is rare for there not to be an injunction in Chambers, and some Littleton members have been involved in successive urgent interim applications for substantial periods.
  • International & Conflict of Laws: Much of the commercial litigation undertaken by our barristers has an international dimension, and Chambers has particular expertise in the conflict of laws issues that this dimension can raise. We are familiar with taking instructions from and working in co-operation with foreign lawyers and experts, working as part of substantial teams both domestically and abroad and with the tactics required to take complex multi-jurisdictional matters to a successful conclusion.
  • Commercial Contract Disputes.
  • Company & Partnership Law: Littleton has expertise in a wide range of company and partnership law disputes. At the commercial contract end of the spectrum members regularly advise and act on disputes arising out of shareholders’ agreements, share sale agreements and partnership agreements, including LLPs. Members of Chambers at all levels act in disputes between (a) partners, often acting for national firms of solicitors and accountants and (b) companies and their directors, including, where appropriate, derivative claims.
  • CIS Dispute Resolution: We have extensive experience of CIS related disputes  Littleton’s commercial team has been involved in substantial CIS litigation and arbitration involving joint venture, commercial contract, commodities, corporate and shareholder and fraud disputes. 
  • Professional Negligence: For many years we have been frequently instructed by a wide range of clients in professional negligence matters. Those clients include financial institutions, surveyors, solicitors, barristers, insurance brokers, accountants, trade unions and individuals. Cases have been heard in the High Court, the Court of Appeal and the Supreme Court and the claims include a full range of typical - and not so typical - professional negligence actions against all sorts of professionals, including solicitors, barristers, surveyors and accountants. They embrace breaches of fiduciary duty and breach of trust principles, solicitors' negligence in mortgage lending cases, contributory negligence and deceit.
