The huge scale of equal pay claims currently facing the public sector is very well known.

Littleton barristers have been involved in many of the cases which have defined the landscape of this legal and political phenomenon.

Key cases include:

  • Potter v North Cumbria Acute Hospitals NHS Trust (no 1, 2 and 3) and Brennan v Sunderland CC two of the largest ongoing public sector lead cases
  • Hurst v Suffolk Mental Health Partnership NHS Trust [2009] IRLR 452 grievance procedures and equal pay
  • Sodexo Limited v Gutridge and others [2009] ICR 1011 TUPE and equal pay
  • Walsall MBC v Birch (2011): limitation and equal pay.

Following on from the public sector equal pay litigation, there is now a growing volume of large-scale private sector equal pay litigation, especially involving the financial services sector, universities and higher education and management consultancy firms. Littleton barristers are already involved in several of these sorts of cases.

Littleton members regularly act for both Respondents and Claimants in smaller scale and individual equal pay claims, often brought alongside more general allegations of sex discrimination. Littleton has particular expertise of such claims arising in the context of City employment, often involving discretionary bonus schemes.
