In Patel v De Vere Group Ltd. (25/4/13, Manchester Mercantile Court) Gavin Mansfield QC acted for the successful Defendant, a hotel group, in defeating a claim by its former Group Accountant for an enhanced redundancy payment. The Claimant was paid an enhanced payment on termination, but sought a further six figure sum, alleging terms implied by custom and practice, variations of his contract, and promissory estoppel. Following an eight day trial HHJ Hegarty QC dismissed all claims, in a judgment which contains a wide-ranging survey of the legal principles applicable when employees try to imply a redundancy scheme into their contract of employment.
