Martin Fodder Acts for Employee in Whistleblowing case

On Friday 21 February the EAT handed down judgment in Western Union Payment Services UK Limited v Anastasiou UKEAT/0135/13/LA which, in dismissing the first part of the employer’s appeal, considers the extent to which a disclosure must refer to “facts” and when it is necessary (and not necessary) for the worker to spell out the relevant failure which he or she believes that the information being disclosed “tends to show”. The EAT allowed the second aspect of the appeal which attacked the ET’s ruling on causation.
