John Bowers QC acted for the General Medical Council (GMC) in their successful high court defence against a claim by the British Association of Physicians of Indian Origin (BAPIO) that the clinical skills assessment (CSA), which includes role-playing assessments is unlawful. In the first case of this kind, the GMC was also acquitted of breach of public sector equality duty. At a judicial review, Mr Justice John Mitting said that the Royal College of General Practitioners (RCGP) was neither racially discriminatory nor in breach of its public sector equality duty.
