The article discusses the leading Court of Appeal judgment in Kaefer Aislamientos SA de CV v AMS Drilling Mexico SA de CV [2019] EWCA Civ 10, [2019] 1 WLR 3514 on the test for permission to serve proceedings out of England and Wales, as well as the appeal in Aspen Underwriting Ltd v Kairos Shipping Ltd, heard before the Supreme Court on 4-5 November.
