In Howarth v Verizon (2013) David Lascelles acted for the successful Defendant, a global telecommunications and IT company, in this complex claim for contractual commission based upon the sale of hundreds of thousands of pounds of telecommunications equipment.
The matter fought over three days before HHJ Elleray Q.C. David succeeded in persuading the Court that the commission sought did not fall within the four walls of the contract and hence was irrecoverable.
The claim was dismissed with a very substantial costs order in David’s client’s favour.
