Uber unsuccessful in appeal against original tribunal decision

Uber have been unsuccessful in their appeal against the original tribunal decision. David Reade QC appeared for Uber in the first instance decision, advancing the agency argument which the EAT has rejected.  The EAT decision upholds the Tribunal decision to apply an Autoclenz approach. It remains a moot point in any case whether the contractual documentation genuinely defines the relationship or, following Autoclenz, the Tribunal is entitled to conclude that there is  different legal reality.
