Jess Varnish’s appeal against the decision of the Employment Tribunal that she was neither an employee or a worker of British Cycling will proceed to a full hearing in 2020. The EAT granted permission on 17 December 2019 for the appeal to proceed to a full hearing and directions will now be given.
Ms Varnish was represented in the Tribunal and at the EAT by David Reade KC and Lydia Banerjee. The appeal raises questions as to the correct legal test when considering employee and/or worker status under the Employment Rights Act and employment status under the Equality Act 2010.
