David Reade QC and Grahame Anderson have been successful in an important Court of Appeal Judgment on agency workers.
In Kocur v Angard Staffing Limited and Royal Mail Group [2022] EWCA Civ 189, in which David Reade KC and Grahame Anderson appeared for both respondents instructed by DAC Beachcroft LLP, it was held by the Court of Appeal that the Employment Appeal Tribunal had been correct in their interpretation of Regulation 13 of The Agency Worker Regulations, whereby an agency worker has the right to be informed by the hirer of any relevant vacant posts with the same hirer during an assignment.
It upheld the EAT’s decision that this right was limited to only notifying vacancies on the same basis as directly recruited employees, but that this did not extend to a corresponding right for agency workers to be given an opportunity to apply for the those vacancies.
