Lucy Bone and James Green in Court of Appeal non-compete case

Important guidance given in non-compete case – Lucy Bone and James Green appeared for Appellant employer in Planon v. Gilligan. The Court of Appeal (Elisabeth Laing LJ, Bean LJ and Nugee LJ) set out central principles for the test of enforceability of covenants and ruled on the American Cyanamid test in the context of a non-compete, in particular issues of delay and adequacy of damages.
