In a number of recent landmark decisions, Courts have grappled with different formulations of a seemingly simple question: what is work? In the wake of Uber v Aslam and Tomlinson-Blake v Mencap in the Supreme Court and DJ v Radiotelevizija Slovenija in the ECJ, this webinar considers this central question by drawing together four strands often viewed separately: worker status, working time, the national minimum wage, and tax liability. David Reade KC, Niran de Silva KC and Georgina Leadbetter (counsel for the Respondent in Tomlinson-Blake v Mencap, instructed by James Davies of Simons Muirhead Burton) will identify the different questions which arise in relation to ‘work’ under the relevant legislation, consider the practical issues which arise when considering matters such as standby time and sleep-ins and share reflections and practical advice on the question of what constitutes ‘work’ within the framework of employment legislation.
