Jeffrey Bacon recently received judgment in a claim against HBOS/Lloyds Banking Group. Jeffrey acted for Kamran Naqvi who was dismissed from his job as a city banker after being accused of moonlighting as a Personal Assistant to David Haye, a well-known boxer. The bank claimed that the claimant had received payments, backhanders and benefits in kind from Mr Haye putting him in breach of Bank and FCA policies.
Mr Naqvi’s claim was successful and the Tribunal found that the Bank had approached the matter with a predetermined decision to dismiss and that no payments were ever made. The Tribunal also concluded that the Bank’s Human Resources and Legal departments had deliberately held back obviously relevant information, that evidence regarding missing documents was not believed and that certain witnesses had produced documents or withheld materials to protect their defence.
