Naomi Ellenbogen QC appeared on behalf of the Home Office in the Supreme Court on 14 and 15 November in a seminal case concerning indirect age and race discrimination. The Court will decide whether, in order to succeed in a claim for indirect discrimination under the Equality Act 2010, a claimant needs to show the reason why a provision, criterion or practice puts or would put (a) the claimant; and (b) persons with whom s/he shares a protected characteristic at a particular disadvantage. Naomi and her junior, John-Paul Waite, succeeded before the Court of Appeal.
