The impact of the result in the appeal
of Day v Lewisham (in which Nicholas Siddall successfully
appeared) is the subject of a report by ITV News. Dr Day there signals his
intention to seek permission to appeal to the Court of Appeal.
The key issue was whether doctors in
training enjoy the requisite legal relationship with Health Education England
(their training organiser) so as to advance a whistleblowing claim. The EAT
accepted Nicholas’ submission that the scope of the whistleblowing provisions
was insufficiently wide so as to capture such a relationship of training
facilitation.
