London South Employment Judge Wright has recently dismissed a claim brought against leading law firm Howard Kennedy LLP by one of their former Equity Partners alleging that he had suffered an unauthorised deduction of wages. As a matter of law, the Tribunal found that a share of profits was not wages for the purposes of the Employment Rights Act 1996. The Tribunal then went on to find on the facts that the Claimant had in any event been paid in line with his agreement with the firm and rejected his claims to be entitled to a greater equity points allocation.
