Gavin Mansfield QC and Alexander Robson are representing the accountants Baker Tilly, who are Claimants in an action brought against six former employees to enforce post-termination non-solicitation and non-poaching covenants.
At a contested hearing for interim relief on 17 October the Honourable Mrs Justice Swift granted the Claimants an interim injunction to last until a further 2-day interim hearing on the Claimants’ application.
The dispute arises out of the acquisition by Baker Tilly of RSM Tenon, and the departure of RSM Tenon partners to competitor Mazars LLP. The case will consider previously unresolved issues as to the effect on restrictive covenants of an objection to a TUPE transfer, and the effect of assignment of the benefit of restrictive covenants.
