Littleton Chambers’ Mohinderpal Sethi KC, Sophia Berry and Bianca Balmelli, instructed by Slater and Gordon Lawyers on a pro bono basis, are appearing for the individual appellant in a ground breaking appeal before the EAT regarding flexible working and the rights of working mothers (Dobson v Cumbria NHS Foundation Trust UKEAT/0220/19/LA). The appeal will determine important questions related to the law of indirect sex discrimination, including whether judges can take judicial notice of the fact that more women than men have childcare responsibilities when assessing group disadvantage. The UK work-life balance charity Working Families has been granted permission to intervene in the appeal.
