Successful Strike-Out Application in Substantial Fraud Claim

The High Court has today handed down judgment in favour of Swiss billionaire businessman and VistaJet owner, Thomas Flohr, striking out a claim against him brought by Frontiers Capital, a Guernsey Limited partnership in control of Timothy Horlick, a colourful British entrepreneur and former husband of City “superwoman” Nicola Horlick. The strike-out application was heard over 7 court days from 2023, including a trip to the Court of Appeal in the middle, and has been reported in the Financial Times, Bloomberg and other press.

Representing Mr Flohr, Jonathan Cohen KC leading Nick Goodfellow and Blathnaid Breslin, instructed by Daniel Astaire and John-Joseph Tyldesley of Grosvenor Law, were successful, not only in striking-out all of the claims on limitation grounds, but also in persuading the court to make wide ranging orders to maintain the confidentiality of a number of allegations made against Mr Flohr which, it was argued, were an impermissible attempt to damage his reputation.
